1. About Brytesoft and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Brytesoft.com and all related services, features, and content (collectively, the “Platform”) operated by SC Trade Group Pte Ltd, located at 391B Orchard Road, #22-00, Singapore 238874 (“Brytesoft,” “we,” “us,” or “our”).
By accessing or using the Platform, creating an account, or purchasing any product, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Platform.
You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding agreements.
2. Updates to These Terms
We may modify these Terms periodically. Any changes will be posted on the Platform with an updated Effective Date. Your continued use of the Platform after such updates constitutes acceptance of the revised Terms.
If these Terms are translated into another language, the English version shall prevail in the event of any conflict, unless required otherwise by applicable law.
3. How the Platform Works
Venue: Brytesoft operates an online marketplace where products, including digital goods and software keys (“Products”), are made available for purchase. Unless expressly stated otherwise in a specific product listing, Brytesoft acts as the seller of record for all transactions conducted through the Platform.
Third-Party Vendors: If a product listing identifies a third-party vendor (“Vendor”) as the seller, that Vendor is solely and independently responsible for the Product, including its description, pricing, availability, authenticity, and compliance with all applicable laws, regulations, and license terms. Brytesoft does not assume any responsibility or liability for Products sold by third-party Vendors.
Brytesoft as Seller: When Brytesoft is identified as the seller of record, it is responsible for the sale, fulfillment, and customer support of the applicable Product, subject to these Terms and any supplemental terms provided at the time of purchase.
4. Your Account and Security
You may browse the Platform without creating an account; however, certain features require registration. You agree to provide accurate, current, and complete information and to maintain and update such information as needed.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Brytesoft immediately of any unauthorized use or security breach. Brytesoft reserves the right to suspend or terminate accounts to protect users, enforce these Terms, or maintain Platform integrity.
5. Orders, Pricing, and Payments
Placing Orders: By submitting an order, you authorize Brytesoft (or its payment processors) to charge your selected payment method for the total purchase amount, including any applicable taxes, fees, or surcharges displayed at checkout.
Pricing and Errors: Brytesoft reserves the right to correct typographical, pricing, or other errors. If a Product’s correct price is higher than the displayed price, we may contact you for confirmation or cancel the order with a full refund.
Currency and Conversion: Prices are displayed in the currency indicated on the Platform. Any currency conversions or foreign transaction fees applied by your financial institution are your responsibility.
Fraud Prevention: Brytesoft may refuse, cancel, or delay an order if fraud, unauthorized activity, or violation of these Terms is suspected. Verification or additional information may be required to process such orders.
6. Delivery, Redemption, and Product Requirements
Digital Delivery: Most Products are delivered electronically (e.g., via digital code or activation key) to the email address or account associated with your purchase.
Redemption: Certain Products may require activation or redemption through a third-party platform or publisher. In such cases, your use of the Product is governed by that provider’s end-user license agreement (“EULA”) or terms of service, which you must comply with.
Compatibility: You are responsible for ensuring that your hardware, software, region, or account settings meet the Product’s requirements. Brytesoft is not liable for incompatibility issues.
7. Refunds and Customer Support
Brytesoft strives to resolve issues fairly and efficiently. If you encounter a problem (e.g., non-delivery, invalid code, or similar), please contact our support team promptly through official channels.
Refunds: Refund eligibility and procedures are governed by our Refund Policy, available on the Platform. Please review that policy for details and timelines.
Chargebacks: We encourage customers to contact us before initiating a chargeback. Brytesoft reserves the right to contest chargebacks and may suspend accounts while disputes are under review.
8. Acceptable Use
You agree not to:
- Use the Platform or any Product for unlawful purposes, infringement, or violation of third-party rights or EULAs;
- Misrepresent your identity or engage in fraud or unauthorized transactions;
- Interfere with Platform functionality or security, including through malware, data scraping, or unauthorized access;
- Resell or commercially exploit Products in a manner inconsistent with applicable license terms or these Terms.
Brytesoft may suspend accounts, cancel orders, or remove listings to protect users and maintain the integrity of the Platform.
9. Intellectual Property and Takedowns
The Platform, including its content, design, and underlying software, is protected by intellectual property laws. All rights not expressly granted are reserved by Brytesoft and its licensors.
Claims of Infringement: If you believe that any content or listing on the Platform infringes your intellectual property rights, please contact [email protected] with:
- Identification of the right or work claimed to be infringed;
- The URL or specific location of the allegedly infringing material;
- Your contact details; and
- A good-faith statement that the claim is accurate.
Upon credible notice, Brytesoft may remove or disable access to the content and share relevant details with the Vendor.
10. User Content and Feedback
If you submit reviews, comments, or other materials (“User Content”), you grant Brytesoft a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for purposes of operating, promoting, or improving the Platform.
You agree not to post unlawful, infringing, defamatory, or misleading content. Brytesoft reserves the right to moderate or remove User Content at its discretion.
11. Third-Party Services and Links
The Platform may contain links to third-party websites or services. Brytesoft does not control and is not responsible for such third-party content, terms, or practices. Your use of third-party services is at your own risk and governed by those providers’ terms and conditions.
12. Disclaimers
THE PLATFORM AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRYTESOFT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
Nothing in these Terms excludes liability that cannot be excluded under applicable consumer-protection laws. Mandatory consumer rights remain unaffected.
13. Limitation of Liability
To the fullest extent permitted by law, Brytesoft and its affiliates, directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising out of or in connection with the Platform or these Terms, even if advised of the possibility of such damages.
In any event, Brytesoft’s total aggregate liability shall not exceed the amount paid by you to Brytesoft for the Product giving rise to the claim within the six (6) months preceding the event. If no such payment was made, the cap is S$100.
14. Indemnification
You agree to indemnify and hold harmless Brytesoft, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from your misuse of the Platform, violation of these Terms, or infringement of third-party rights.
15. Suspension and Termination
You may stop using the Platform at any time. Brytesoft may suspend or terminate your access, with or without notice, if it reasonably believes that you have violated these Terms, engaged in fraud, or acted unlawfully.
Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) shall continue in effect.
16. Force Majeure
Brytesoft shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, or internet outages.
17. Governing Law and Jurisdiction
These Terms and your use of the Platform are governed by the laws of Singapore, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Singapore for any dispute arising under or related to these Terms, subject to any non-waivable consumer rights in your country of residence.
18. Miscellaneous
Entire Agreement: These Terms, together with any incorporated policies (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and Brytesoft.
No Waiver: A failure to enforce any provision of these Terms shall not constitute a waiver.
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. Brytesoft may assign these Terms in connection with a merger, acquisition, or sale of assets.
Notices: Brytesoft may send notices electronically to your account email or via posting on the Platform. Legal notices to Brytesoft must be directed to the contact address below.
Headings and Interpretation: Headings are for convenience only and do not affect interpretation. “Including” means “including, without limitation.”
Language: These Terms are drafted in English; the English version controls where permitted by law.
